Why didn’t a driver see you?

If someone drives into you, there’s a high likelihood it was because they did not see you. Or they saw you so late that they were unable to take avoiding action.

It does not matter how big your vehicle is, or how brightly colored the paintwork is – you still run the risk of other drivers not seeing you. Here is why:

Many drivers are not looking

The harsh truth of the modern road is that a huge amount of drivers are not looking where they are going. While distraction has always been possible, the modern world is far more distracting than in days gone by. Just think about how hard most people find it to concentrate on a conversation without checking their phone, to watch TV without flicking through the channels, or simply to sit down and read a book.

Driving is no different. Modern drivers face roads lined with constantly changing electronic billboards and cars filled with buttons and dials to adjust everything from the angle of seat recline to the cruise control limit. They still have passengers and pets inside the car to distract them inside the car, and goings-on outside the window to hold their attention a little too long. And, on top of it all, they have the ever-present cell phones, complete with in-car systems so you can use your phone even when it’s out of your sight.

Drivers have a duty to avoid succumbing to distraction

Driving a car comes with a lot of responsibilities, one of which is the responsibility to stay focused and alert. If a driver injures you because they were not focused, they should consider it their responsibility to see you get the compensation you need.
